These Terms and Conditions (“Terms”) govern your use of the LoboHost website at lobohost.com and all services provided by LoboHost (“we,” “us,” or “our”). By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, do not use our website or services.
1. Acceptance of Terms
By submitting an inquiry, signing a service agreement, or using any LoboHost service, you confirm that you have read, understood, and agree to these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.
2. Services
LoboHost provides managed hosting, SSL certificate management, web hosting, and domain registration services. The specific scope, pricing, and delivery timeline for each engagement are defined in a separate written proposal or service agreement provided to you prior to the commencement of services.
We reserve the right to modify, discontinue, or add to our service offerings at any time. Changes that materially affect active service agreements will be communicated with at least 30 days' notice.
3. Client Responsibilities
You agree to:
- Provide accurate, current, and complete information when submitting inquiries or establishing your account.
- Maintain the confidentiality of your account credentials and notify us immediately of any unauthorized access.
- Use our services only for lawful purposes and in compliance with these Terms and all applicable laws and regulations.
- Promptly respond to communications from LoboHost when your response is required for service delivery.
4. Acceptable Use
You may not use LoboHost services to:
- Host, distribute, or transmit content that is unlawful, defamatory, harassing, abusive, fraudulent, or obscene.
- Send unsolicited bulk email (spam) or engage in any form of email abuse.
- Conduct or facilitate unauthorized access to computer systems, networks, or data.
- Distribute malware, viruses, or any other malicious code.
- Consume an unreasonable or disproportionate share of server resources in a way that degrades service for others.
- Engage in activities that violate the terms of service of upstream providers or applicable law.
Violations of this Acceptable Use Policy may result in immediate service suspension without refund, at our sole discretion.
5. Payment and Billing
Fees for services are as set out in the applicable proposal or invoice. Payments are processed by Stripe, Inc. By providing payment details, you authorize LoboHost to charge the applicable fees through Stripe on the agreed billing cycle. LoboHost does not store your full card number; payment data is handled directly by Stripe in accordance with their Privacy Policy.
Unless otherwise agreed in writing:
- Invoices are due within 15 days of issuance.
- Overdue invoices may result in service suspension after 7 days' written notice.
- Services suspended for non-payment may be terminated after 30 days, with associated data subject to deletion.
6. Refund Policy
LoboHost provides managed, hands-on services that begin immediately upon engagement. Because work commences promptly, our refund policy is as follows:
- Setup and onboarding fees are non-refundable once work has commenced.
- Monthly recurring servicesare billed in advance and are non-refundable for the current billing period. You may cancel at any time with 30 days' notice; no further charges will be made after the notice period ends.
- Annual plans may be eligible for a pro-rated refund for unused full months, provided cancellation is requested within the first 30 days of the annual term. After 30 days, annual fees are non-refundable.
- Domain registrations are non-refundable once the domain has been registered with the registry, as those costs are passed directly to the domain registry and cannot be recovered.
- SSL certificates are non-refundable once issued.
If you believe you have been charged in error, please contact us within 30 days of the charge. Disputes submitted beyond 30 days may not be eligible for review. Initiating a chargeback with your bank or card issuer without first contacting LoboHost may result in immediate service suspension.
7. Service Availability
We target 99.9% monthly uptime for managed and web hosting services. This excludes scheduled maintenance windows, which we will communicate at least 48 hours in advance whenever possible, as well as outages caused by factors outside our reasonable control (see Section 11).
Uptime commitments, where applicable, are defined in your individual service agreement and represent targets, not guarantees.
8. Data and Backups
Where backup services are included in your plan, we will maintain copies according to the schedule and retention period defined in your service agreement. While we take reasonable precautions to protect your data, you remain solely responsible for maintaining your own independent backups of critical data.
LoboHost is not liable for data loss arising from hardware failure, software errors, or circumstances outside our reasonable control, except where directly caused by our gross negligence.
9. Intellectual Property
You retain all rights to your content, data, and intellectual property hosted on LoboHost infrastructure. You grant LoboHost a limited, non-exclusive license to store, process, and transmit your content solely as necessary to provide the contracted services.
LoboHost retains all rights to its systems, software, tools, methodologies, and the lobohost.com website. Nothing in these Terms transfers ownership of our intellectual property to you.
10. Confidentiality
Each party agrees to keep confidential any non-public information of the other party that is disclosed in connection with the services and marked or reasonably understood to be confidential. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
11. Limitation of Liability
To the maximum extent permitted by applicable law, LoboHost's total cumulative liability to you for any claims arising out of or related to these Terms or the services — whether in contract, tort, or otherwise — shall not exceed the total fees paid by you to LoboHost in the 12 months preceding the event giving rise to the claim.
In no event shall LoboHost be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages.
We shall not be liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, acts of government, internet infrastructure failures, or third-party provider outages.
12. Termination
Either party may terminate a service agreement with 30 days' written notice, unless the applicable service agreement specifies a different notice period.
We may terminate or suspend services immediately and without notice if you breach the Acceptable Use Policy (Section 4), fail to pay overdue invoices after the notice period, or engage in conduct that poses a security risk to our infrastructure or other clients.
Upon termination, you are responsible for retrieving your data within the period specified in your service agreement (minimum 14 days after notice). After that period, we may delete your data without further obligation.
13. Governing Law and Disputes
These Terms are governed by applicable law. In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or, where arbitration is not available, through the courts of competent jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. We will update the “Last updated” date at the top of this page. For material changes, active clients will receive email notice at least 30 days before the changes take effect. Continued use of our services after that date constitutes acceptance of the updated Terms.
